Content Creator Agreement

This Content Creator Agreement ("Agreement") governs the relationship between the Creator and JustforfansAPP, operated by Capablanca Digital OÜ, Tallinn, Estonia.

By creating a Creator account, uploading content, or clicking "I agree", the Creator confirms acceptance of this Agreement and all applicable policies of the platform.

1. Parties

This Agreement is entered into between the Creator and JustforfansAPP operated by Capablanca Digital OÜ, Tallinn, Estonia.

2. Eligibility

The Creator confirms that:

  • The Creator is at least eighteen (18) years old.
  • The Creator is legally capable of entering a binding agreement.
  • The Creator will comply with all applicable laws and platform policies.

3. Content License

The Creator grants JustforfansAPP a worldwide, non-exclusive, royalty-free license to host, reproduce, distribute, and display the Creator's content for the operation, promotion, and marketing of the platform.

JustforfansAPP reserves the right to remove, refuse, or moderate any content that violates platform policies or applicable laws.

4. Prohibited Content

The Creator agrees NOT to upload content that:

  • Violates any applicable law.
  • Violates intellectual property rights.
  • Contains non-consensual content.
  • Contains minors or individuals under 18 years of age.
  • Promotes violence, abuse, or harassment.
  • Violates payment network rules or platform standards.

5. Consent and Age Verification

The Creator represents and warrants that:

  • All persons appearing in the content are at least eighteen (18) years of age.
  • The Creator has verified the identity and age of all persons depicted using valid government-issued identification.
  • The Creator has obtained written consent from all persons appearing in the content.

The written consent must include:

  • Consent to be depicted in the content.
  • Consent for public distribution of the content.
  • Consent to upload the content to the JustforfansAPP platform.
  • If applicable, consent to allow downloading of the content by users.

The Creator must retain these consent forms and identification documents and provide them to JustforfansAPP upon request for compliance verification.

6. Record Keeping (2257 Compliance)

Creators are responsible for maintaining records required under 18 U.S.C. §2257 and §2257A where applicable.

Creators must maintain age verification and consent records for all individuals appearing in the content and provide such records upon request to JustforfansAPP or appropriate authorities.

JustforfansAPP designates a Custodian of Records for compliance purposes as published on the platform.

7. Content Moderation

All content uploaded to the platform is subject to review and moderation.

JustforfansAPP may remove any content that violates platform rules, applicable laws, or payment network standards.

8. Indemnification

The Creator agrees to indemnify and hold harmless JustforfansAPP from any claims, damages, or liabilities resulting from content uploaded by the Creator.

9. Enforcement

Violation of this Agreement may result in content removal, account suspension, or termination.

JustforfansAPP may cooperate with law enforcement authorities when required.

10. Governing Law

This Agreement shall be governed by the laws of Estonia. Any disputes shall be resolved in the competent courts of Estonia.
